Robert Horst
(1991)
Robert Horst (VLS 1991) writes, "In response to an environment of increasing litigation within our client base, attorneys from Nelson Levine De Luca & Horst, a national law firm focused on the insurance industry, have authored “Extra-Contractual Litigation Against Insurers,” a book published this month by Law Journal Press. Written by firm founder Robert T. Horst, Partner Mark H. Rosenberg and edited by firm Chairman Michael R. Nelson, the book examines both the legal underpinnings of novel causes of action and the practical aspects of bringing claims and defending against them.
According to Horst, the topic is particularly timely due to the increase in legal actions against insurers as well as new and novel strategies of plaintiffs. “No matter which side of the fence you're on, this book will help you assess the viability of a claim and represent your clients effectively,” he said.
The authors provide a detailed discussion of trial tactics, covering each phase of trial from commencing an action through discovery, evidentiary rulings and jury instructions, to verdict and damages. Specific topics include the insurer's third-party bad faith in refusing to settle; first-party bad faith in refusing to pay benefits; bad faith claims involving specific lines of insurance; common law claims; unfair claims settlement practices; alternative theories of liability, and more.
All three authors have extensive legal experience representing insurers in a number of business matters. “Our careers have been completely devoted to the business of insurance. We’re grateful for this opportunity to bring our knowledge together and share insights on litigated insurance disputes from both sides of the table,” said Horst. The book may be purchased at lawcatalog.com."
